Move-out carpet cleaning and your California deposit

Can a landlord charge for carpet cleaning from a security deposit?
A California landlord can deduct carpet cleaning from a security deposit only as needed to return the unit to the level of cleanliness it had when the tenancy began, under Civil Code 1950.5, and can’t deduct for ordinary wear and tear. Traffic-lane wear on old carpet is wear and tear; stains and soil beyond the move-in condition are what a deduction can cover.
Landlord carpet cleaning requirements
A lease can ask a tenant to have the carpet cleaned at move-out, but any deduction still has to fit Civil Code 1950.5: reasonable, and tied to returning the unit to its move-in cleanliness. Ask the landlord in writing what they expect, and keep the cleaning receipt.
Timing carpet cleaning before the move-out walk-through
- Ask for the initial inspection California law allows, up to two weeks before you move out, to learn what the landlord would deduct
- Book the cleaning after the furniture is out and before the final walk-through
- Leave time to dry: carpet stays slightly damp for 6 to 12 hours
- Keep the receipt and take dated photos of the clean carpet
How long a landlord has to return the deposit
A California landlord has 21 days after the tenant moves out to return the deposit, with an itemized statement of any deductions and, for larger amounts, receipts or invoices for the work (Civil Code 1950.5).
